PUWER Regulations and Permit to Work: What Maintenance Teams Need to Know
Maintenance work on plant and equipment is one of the most permit-to-work-intensive activities on any site. Before any maintenance technician can start work on a piece of machinery, several legal requirements need to be satisfied — and the Provision and Use of Work Equipment Regulations 1998 (PUWER) is the framework that sits behind most of them.
This guide explains what PUWER requires for maintenance work, how the PUWER inspection cycle feeds into your permit-to-work system, and what maintenance teams should see on a permit before they start.

What PUWER requires
The Provision and Use of Work Equipment Regulations 1998 (SI 1998/2306) apply to all work equipment used in the course of work activities. "Work equipment" under PUWER is broad: machinery, tools, vehicles, plant, and any appliance used at work falls within scope.
Three regulations are particularly relevant to permit-to-work:
Regulation 4(1) — Suitability: "Every employer shall ensure that work equipment is so constructed or adapted as to be suitable for the purpose for which it is used or provided." Before maintenance work begins, equipment must be suitable for the maintenance task — not just for its primary function. This includes confirmation that isolations are in place, guarding is removed only as necessary, and access is safe.
Regulation 5(1) — Maintenance: "Every employer shall ensure that work equipment is maintained in an efficient state, in efficient working order and in good repair." Maintenance work is itself covered by PUWER — the tools and equipment used by the maintenance team must meet the regulation's standard, not just the plant being worked on.
Regulation 6(2) — Inspection: "Every employer shall ensure that work equipment exposed to conditions causing deterioration which is liable to result in dangerous situations is inspected — (a) at suitable intervals; and (b) each time that exceptional circumstances which are liable to jeopardise the safety of the work equipment have occurred, to ensure that health and safety conditions are maintained and that any deterioration can be detected and remedied in good time."
Regulation 6(3) requires the results of every inspection to be recorded and kept until the next inspection under this regulation is recorded.
How PUWER connects to permit to work
The link between PUWER and the permit system operates at several levels:
Pre-maintenance inspection. The PUWER inspection record for a piece of equipment establishes its known condition. A permit to work on a machine should reference the last PUWER inspection — confirming that the equipment was in a known, recorded state before the maintenance work started. If the last inspection is overdue or the equipment has been involved in "exceptional circumstances" (a collision, overload, or abnormal operation) since the last inspection, the permit should reflect this.
Isolation confirmation. PUWER regulation 19 requires that machinery is isolated from its energy sources before maintenance. For electrical equipment, this typically means lock-out/tag-out with a verified dead circuit (the prove-test-prove method). The electrical isolation permit template is specifically designed to capture this — it records the isolation points, the persons who applied locks, and the confirmation of a dead circuit before the work begins.
Guarding removal and re-instatement. Much maintenance work requires guards or protective devices to be temporarily removed. PUWER regulation 11 requires that work equipment is guarded adequately, and that guards meet specific standards. A permit to work should record which guards have been removed, who removed them, and the requirement to re-install and verify them before the equipment is returned to service.
Return to service. The close-out of a PUWER-connected permit should include: re-instatement of all guards, reconnection of all isolations, confirmation that all personnel are clear, and a functional test before the equipment is returned to normal operation.
What maintenance permits should include
A permit for maintenance work on plant or equipment should capture:
Equipment identification: The specific machine, plant reference, and location — not just "conveyor belt" but the specific belt, its reference number, and its physical location. PUWER records should match.
PUWER inspection status: Date of last PUWER inspection and confirmation it is current. If the inspection is overdue, the permit should either halt the maintenance until the inspection is done or record a specific exception with justification.
Isolation confirmation: For every energy source — electrical, pneumatic, hydraulic, thermal, and potential energy (springs under tension, elevated loads) — the permit should record each isolation point, the isolation method (lock-out/tag-out), and the person responsible. Guards removed: List of specific guards or covers removed, with the method for verifying re-instatement before close-out.
Competence confirmation: The maintenance technician should be confirmed as competent for the specific work. PUWER regulation 9 requires that work equipment is used only by people who have received adequate training for the purposes of health and safety.
Time limit: A maintenance permit should have a specific time limit, not an open-ended authorisation. If the maintenance overruns, the permit should be closed and a new one issued — partly because conditions can change and partly because an open permit creates an implicit message that the equipment is safe to approach.
Common PUWER permit failures
No isolation record. A permit that says "equipment isolated" without recording which isolations were applied, by whom, and verified how, is inadequate for PUWER and provides no protection if a person is injured by unexpected energy release. Energy isolation in maintenance is the single highest-risk step — the permit is where this is documented.
Guard re-installation not verified at close-out. In busy maintenance environments, guards are frequently not re-installed before equipment is returned to service. A permit close-out that requires a specific person to confirm guards are back in place prevents this.
Multiple isolations — who removed the lock? Where multiple tradespeople are working on the same isolated equipment, PUWER isolation management requires that each person who needs isolation protection has their own lock or equivalent. A permit should record each person and their individual isolation lock — not just a single "isolated" entry.
Inspection records missing. A machine that has been involved in an abnormal event since its last PUWER inspection should not have maintenance started without the inspection being completed first. A permit that doesn't reference the inspection status misses the PUWER hook.
No return-to-service step. PUWER maintenance permits should include a formal return-to-service step: isolations removed in controlled sequence, guards re-installed, personnel clear, functional test completed. A permit that ends at "work finished" without these steps creates liability if the equipment fails after maintenance.
PUWER, LOLER and maintenance permits
Where maintenance work involves lifting equipment, PUWER and LOLER overlap. A crane undergoing maintenance is covered by PUWER (as work equipment) and LOLER (as lifting equipment). The permit system needs to address both sets of requirements:
- PUWER: suitability, maintenance state, isolation, guarding
- LOLER: thorough examination status, competence of lifting equipment maintenance personnel, records kept and accessible
For this overlap, the permit or accompanying documentation should reference both sets of requirements and confirm both are satisfied before work begins.
Practical steps
If your maintenance permit system is not currently structured around PUWER requirements, the starting point is to:
- Map your maintenance activities against the PUWER regulation structure: what equipment, what isolation requirements, what guard removal/re-installation steps.
- Add PUWER inspection reference to your permit template — a field for "last PUWER inspection date" and "inspection current: Y/N."
- Implement per-person isolation records on permits where multiple tradespeople may be working on the same isolated equipment.
- Add a formal return-to-service checklist to the permit close-out section — guards, isolations, clear of personnel, functional test.
- Audit completed permits against your PUWER inspection records quarterly to confirm alignment.
